FLS Transportation Services, Limited and its affiliated companies including FLS Warehousing Inc. and FLS Transportation Services (USA) Inc. (together herein referred to as “FLS”, the “Company”, “we”, or “us”) are firmly committed to protecting your privacy. FLS has created this Global Data Privacy Policy (“Privacy Policy”) to explain our commitment to keeping Personal Information private and secure. “Personal Information” means any information that relates to an individual to the extent that any individual is or can be identified from that information. Personal Information can be in any form (e.g., paper, electronic, video, audio). It is FLS’s policy to take all necessary steps to ensure that all Personal Information processed by us is processed lawfully. All of our employees and Third Party Service Providers who have access to Personal Information need access to this information for business reasons and/or their duties reasonably require such access, and they are obliged to respect the confidentiality of Personal Information and comply with this Privacy Policy. We are committed to treat the information of our customers, partners, stakeholders, and other interested parties with the utmost care and confidentiality.

 

Scope

This Privacy Policy applies to all online and offline, collected, stored, processed, transferred and used Personal Information of FLS’s customers, vendors, suppliers, service providers, contractors and others who share their Personal Information with us. This Privacy Policy does not govern the Personal Information that we collect, use or disclose about our employees which is governed by a separate policy. This Privacy Policy is global in nature and governs our data protection practices whether we collect your Personal Information through one of our Website located at www.flstransport.com (“Website”) or through other means. When we collect information about you other than through one of our Website, we will first obtain your permission to do so, if and as required by applicable law. However, by using any FLS Website on which this policy is posted, you agree that this Privacy Policy governs our collection, use, and disclosure of any Personal Information submitted to us on or through that Website. If you do not agree to be bound by this Privacy Policy, you may not access or use our Website and you should not submit your personal information to FLS.

 

Information Collection

General sources. There are various methods by which FLS collects Personal Information. We may collect Personal Information from individuals as voluntarily disclosed via our Website, in person, over the phone, through the postal mail service, e-mail or upon customers, vendors, service providers and/or contractors opening an account with us.

  • We may use online advertising services, (such as Google AdWords or similar types of services), to advertise FLS across the Internet and to advertise on third party websites (including Google) to previous visitors of our websites. These services will display ads to you based on what parts of the FLS website you have viewed by placing a cookie on your web browser. It could mean that we advertise to previous visitors who haven’t completed a task on our Website or this could be in the form of an advertisement on the search engine results page. Information Use

We collect Personal Information that is knowingly and voluntarily provided to us in order to create, establish and administer customers’ and vendors/service providers’ accounts and to respond to customer or vendor/service providers’ inquiries, to authenticate the identity and preserve the privacy of individuals contacting FLS and for internal training and quality assurance purposes, as well as for the following purposes:

Customer: We collect and process Personal Information about our customers in order to efficiently provide the services necessary to support an entire supply chain solution, and other services that involve the transport and storage of goods more generally. In addition, subject to your Right to Withdraw Consent, we may use your Personal Information to correspond with you regarding possible new or enhanced business opportunities.

Vendor: We collect and process Personal Information about any vendor we retain in order to ensure that we are able to contact our vendors when necessary, and to ensure that FLS’s standards of service/care are met, or as otherwise authorized by law. In addition, subject to your Right to Withdraw Consent, we may use your Personal Information in order to correspond with you regarding possible new or enhanced business opportunities.

Applicant: If you have applied for employment with FLS, the Personal Information submitted with your job application will be used for recruitment and other customary human resources purposes. For example, we may send you information about new job opportunities within FLS as well as other career development resources.

 

Right to Withdraw Consent

Consent may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice; however, without such consent, FLS may limit the services or products it is able to provide customers. You may also withdraw your consent as follows:

Mail marketing, Telephone and Quality control communications. You may decide that you prefer FLS not to use your Personal Information to promote new and/or additional products and/or services which may be of interest to you and refuse that we contact you by mail or telephone for marketing purposes or by email or telephone for quality control purposes. If this is the case, you may advise us by contacting customer service or contacting us using the information detailed in the CONTACT INFORMATION section below.

Commercial Electronic Communications. You can always limit the communications that FLS sends to you. To opt-out of commercial emails, simply click the link labeled “unsubscribe” or “opt-out” at the bottom of any commercial electronic communication we send you. Please note that even if you opt-out of promotional communications, we may still need to contact you with important information about your account.

Disclosure

Third party service providers. FLS may contract with other companies such as vendors, suppliers, service providers and/or contractors, or individuals (“Third Party Service Providers”) to perform certain duties on our behalf. In so doing, it may be necessary that we provide Third Party Service Providers with access to Personal Information. Our Third-Party Service Providers are required to maintain the confidentiality of the Personal Information, and are restricted from using the information for any other purpose than the purposes defined by FLS. Examples of duties performed by Third Party Service Providers include transporting shipments, unloading or assembling freight, delivering packages, providing IT services, sending postal mail, auditing or analyzing data, processing credit card and online bill payments, processing payments, processing payroll, administrating benefits, and recruiting employees, agents, or contractors. We take appropriate measures, by contract or otherwise, to provide adequate protection for Personal Information that is disclosed to our Third-Party Service Providers, and to ensure that our Third Party Service Providers have sufficient legal, organizational and technical procedures in place to protect Personal Information in accordance with applicable data protection law.

As permitted or required by law. We also may provide Personal Information to government agencies and regulatory and legal authorities as required by law or regulation. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful or to law enforcement and emergency services providers, in an emergency or where required or permitted by law. We may release certain Personal Information when we have reasonable grounds to believe that such release is reasonably necessary to protect the rights, property and safety of others and ourselves, in accordance with or as authorized by law.

Business transaction. We may disclose Personal Information to a third party in connection with a sale or transfer of business or assets, an amalgamation, re-organization or financing of parts of our business. However, in the event the transaction is completed, your Personal Information will remain protected by applicable data protection laws. In the event the transaction is not completed, we will require the other party not to use or disclose your Personal Information in any manner whatsoever and to completely delete such information.

 

Cross-Border Transfer of Personal Information

Personal Information collected and used by FLS may reside in or be transferred to any country where we conduct business. Our Website may provide links to other sites for your convenience and information. These sites may operate independently from FLS. Linked sites may have their own privacy notices or policies, which we strongly suggest you review. In addition, a link to a non-FLS site does not mean that we endorse or accept any responsibility for the content, or the use, of such site. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, worms, Trojan horses and other items of a destructive nature. FLS is not liable for the privacy practices or the content of other sites and to the extent any linked sites you visit are not owned or controlled by us, we are not responsible for the sites’ content, any use of the sites, or the privacy practices of the sites.

 

Security Measures

We maintain reasonable administrative, physical and technological measures to protect the confidentiality and security of information about you. Unfortunately, no site, server or database is completely secure or “hacker proof.” To the extent permitted by applicable law, we therefore cannot guarantee that information about you will not be disclosed, misused or lost by accident or by the unauthorized acts of others.
